Accident When Motorist Alone

DUNEDIN, Tue. (PA).—The contention that there was no obligation in law on a motorist travelling alone to report an accident in which.no other vehicle was involved, was upheld by Mr J. D. Willis, S.M., in the Magistrate's Court, when in a reserved judgment, he dismissed a charge of failing to report an accident to the nearest police station. The case arose from an accident near Alexandra in which a car struck a rock and capsized, the driver being injured and later assisted from the car by passing motorists. In the judgment the magistrate quoted a former Chief Justice (Sir Michael Myers) that “the underlying idea of the section was to ensure as far as possible the protection and safety of an injured person so that he might not be left in his injured condition to run the risk of further injury by reason of his being left on the road or perhaps to die for lack of attention.”
