AUCKLAND. Thu. tP.A.)— Sentencing Henry Clifton Sallery to the maximum term of three months’ imprisonment for keeping and using Shortland Street premises as a common gaming house. Mr H. Jenner Wily. S.M.. in the Police Court yesterday, described him as a persistent offender, who had continued for many years to flout the law.
Sallery pleaded guilty. The police said that when they visited the premises on the afternoon of .July 9 they took in two hours over the telephone bets totalling £6l.
Sallery was arrested. Defending counsel said Sallery was in his 60th year. The case could have been defended, but that would have meant bringing outside people to give evidence. There was only one telephone on the premises.
Sallery had wanted to break his connection with betting, but people continued to ring him with bets. He accepted the bets for someone else.
The magistrate said a fine in this case would not be appropriate. "Two terms of imprisonment have not stopped him." Mr Wily added, "and I see no reason why the maximum penalty should not be inflicted.” Counsel filed notice of appeal and Sallery was released pending the hearing of the appeal.
