Gao! For Second ‘Bookie’ Conviction
DUNEDIN. Mon. (P.A.).— imprisonment would follow a second conviction for bookmaking, said Mr J. D. Willis, S.M. in the Dunedin Magistrate’s Court today.
Mr Willis said lie felt it his duty to make a pronouncement on the matter as recent sentences in other courts showed that a clear direction from the former Chief Justice (Sir Michael Myers) in the Court of Appeal had been ignored. Mr Willis quoted Sir Michael as follows: “If a person has been lined several times or even once for this offence, and nevertheless continues in. defiance of the law to carry on business, it is plain that ho regards the fine as nothing more than a licensing fee.
"To such licensing systems, this coui\ cannot allow itself to be a party. If it did permit such a system it would itself be flouting the law, encouraging lawlessness and indeed legislating in a manner contrary to the enactment of Parliament itself.
“So long as the law remains as it is, the duty of the court is to enforce it.”
