Motion For New Trial Dismissed

Reserved judgment was given in the Supreme Court today by Mr Justice Gallon on a motion by the Northern Publishing Co., Ltd., of Whangarei (Messrs V. R. Meredith and R. K. Trimmer) for a new trial in respect to a claim by Mrs Mary Ann White, widow of Kerikeri (Mr W. C. Wylie, of Kaikohe) against the Northern Publishing Co., Ltd., in which a jury had found for plaintiff and awarded £2717 damages. The claim arose out of the death of plaintiff’s husband, following an acci-1 dent to a bus which he was driving while in the employment of defendant compay. His Honour traversed at length the legal argument submitted for and against the motion for a new trial, in conjunction with the evidence, and decided that the jury’s finding as to the defendant company’s responsibility j for the road-worthiness of the brakes of the bus was justified on the evi- 1 dence. The motion was dismissed, with £l2 12/- costs, .against the defendant company, and judgment was given for damages in accordance with the verdict of the jury, with costs.
