Millar, aged 19, of Feilding, was found guilty of placing an obstruction on the railway line at Feilding on July 28. The case v/as the outcome of the railway car, in v/hich Mr H. G. Mackley, general manager of railways, was travelling, striking a boulder weighing 371bs and large enough to derail the train. Fortunately the driver saw the obstruction, and slowed down, but not quickly enough to avoid striking it. Accused’s explanation was that he had taken the boulder to the line with the intention of breaking it, and when his attention was distracted by a rabbit, which he and a companion chased, he forgot about the stone. The jury recommended mercy on account of accused’s mental state.
