ALLEGED PERJURY
CHARGES AGAINST' CONSTABLE. DRUNKENNESS ASSERTED. I THE ARREST OF LOCKETT. I i j DUNEDIN, January 21. j After several adjournments, the perIjury charges against Constable George ! Macartney were proceeded with toI day at the City Police Court. ! This was a sequel to the action in 1 the Supreme Court in November last, I when J. W. Lockett was awarded (substantial damages against the eouj stable for assault and false arrest.
Constable Macartney has been in the police force for 28 years. It is about 20 years since a Dunedin police constable has been charged with perjury, and in that case the information was dismissed.
Accused today was represented by Mr A. C. Hanlon, who had defended him in the civil action. The Crown Solicitor, Mr F. B. Adams, conducted
the prosecution. I The charges wore as follow: —(1) IThat George Macartney, of Dunedin, | a police constable, did on November |‘s, 1920, commit perjury on the hoarjing of an action brought in the Suj preme Court at Dunedin by John Wil- [ liam Lockett against him, by swearing ; (a) that at about half past 11 on the night of July 23, in Kcmmiir Road, Mornington, Lockett was very drunk and that he then and there arrested Lockett for drunkenness in a public place, and (b) that when corning along the road Lockett was staggering all over the road and smelt very strongly of liquor, (e) that Lockett was staggering all over the road and was drunk and thoroughly drunk, and (d) that when he load Lockett in the watch house, and put him in the cell, he was still drunk. ,
Accused was also charged with that on November 3rd, 102(i, at Dunedin, lie did commit perjury on the hearing of an action brought in the Supreme Court at Dunedin by Lockett against him by swearing that he never at any time struck Lockett, a blow of any description, either with his clenched fist or otherwise during the | whole of the struggle between himself | and Lockett on the night of July 23. j Lockett gave evidence which was practically identical with that given by him in the Supreme Court and, be-, fore that in the Police Court, when j he was charged with drunkenness. j The case was then adjourned till 10J a.m. on Tuesday.—Press Assn. j
