Governor-General And Importers’ Petition OFFICIAL NOTIFICATION Per Press Association. AUCKLAND, Last Night No action is to be taken by his Excellency the Governor-General, Viscount Galway, in connection with the petition which the Bureau of Importers fo-ward-ed to him asking him to Ki\cr.<i the operation of the Import Control Hcgulations, 1938. pending their validity being determined by a Court of law The following letter has now been received from the official secretary to :ho Governor-General:— “I am now directed by the Go/eruorGeneral to inform you that his Excellency has consulted the Prime Minister in regard to the suggestion mark* in the petition that the regulations are not irtra vires, and that his Excellency has beeu informed by the Prime Minister that the Attorney-General, who had considered the legal aspect of 2he matter before the regulations were submitted to the Governor-General in the Executive Council, adheres to the opinion which he previously expressed, that the regulations arc intra vires. “His Excellency directs me to add for your information that in' matters of this kind the Governor-General acts on the advice of the Prime Minister. Tn this case, having asked for confirmation of legal opiniou, the Governor- t General has no intention of acting contrary to the advice of the Prime Minister. ” Commenting on this communication officers of the bureau said it now became a question as to whether the Governor-General had been rightly or wrongly advised by his responsible Ministers. This point would be determined when a test case was heard in the Supreme Court at Auckland on April 24.
