Damages Sought by Clergyman
ENGLISH DIVORCE ECHO SYDNEY, June 3. An English clergyman is seeking to rocover damages hero from a Sydney University Medical School lecturer, arising out of divorce proceedings in England in 1935. A firm of Sydney solicitors, acting oil behalf of the clergyman, made an application before Mr. Justice Bavin for leave to register in New South Wales, a verdict for damages of £SOO given m England. Tho verdict was obtained against H L. Brose, who had been named as co respondent iu a suit for divorc brought by David Stephens against hi; wife, Dorothy Mary Stephens. Mr. Stephens is the minister of the Boule vard Congregational Church, Nottingham, England, and Brose was describee before tho Court as a doctor or lecturer at tho Medical School at the University of Sydney. According to testimony before Mr. Justice Bavin, Brose paid £75 of the damages while iu England, leavin £425, wihcli was to bo paid direct t plaintiff. Between November, 1936, an February last, in Sydney, Brose ha promised to mako restitution of th‘ sum unpaid, but only £l2 10s had bee tendered and a largo amount remai: ed. Registration of the judgment unde tho Administration of Justice Act, 192 was necessary for enforcement again* Brose. This provides that applicatio may bo made by summons or motion for tho registering in New South Wale,, of any judgment which has been obtained in a Superior Court of any part of tho British Dominions. Leave to register was granted.
