Supreme Court Reduces Penalty
APPEAL BY CONVICTED MOTORIST. Per Press Association. WELLINGTON, March 2G. In the Supremo Court to-day Mr Justice Smith heard au appeal by Paul Stafford Gillingham, public accountant, against au order suspending his license to drive a motor car for a period of three months. The ground of the appeal was that the penalty imposed by the Magistrate was disproportionate to the offence charged against appellant. Evidence was given by a traffic inspector that defendant had driven on the Hutt road at a speed of 50 miles an hour. The Court, in its judgment, reduced the period of suspension of the driving license from three months to one week. Mr Justice Smith said that, as appellant had already had that period of suspension, he would thus suffer no further penalty. The Magistrate’s order was varied accordingly and the appeal was allowed.
