APPEAL COURT STRIKES SOLICITORS OFF ROLLS
ONE SHOWS £7OOO SHORTAGE. Per Press Association. WELLINGTON, Last Night. Two applications to have solicitors struck off the rolls were made in the Court of Appeal to day by Mr. A. E. Meek, on behalf of the Now Zealand Law society. There were on the Bench their Honours Mr. Justice Herdmnn, Mr. Justice Adams, Mr. Justice MacGregor, and Mr. Justice Kennedy. The case of Hector Bobert Malcolm was described by Mr. Meek as a bad one. Malcolm, who was a solicitor, recently practising in Auckland, had absconded, and his affairs were being administered in bankruptcy. Investigations showed a shortage of over £7OOO in his trust account, and there were specific complaints of his having received £450 from one client and over £IBOO from another and converted the money to his own use. In view of those facts, Mr. Meek submitted, there was only ono course for their Honours to adopt. An order was made striking Malcolm off tho rolls. Tho New Zealand Law Society was allowed £ls 15s costs. The second case was that of Percival Lewis Cribb Inder, of Christchurch. Mr. Meek said that between April and August, 3928, various sums of money, totalling £llß, bad been paid to Inder, and had not been paid into the trust account of the firm in which he had been a partner. Ho had also received £250 from a client and had converted the money to his own use. Mr. Justice Adams mentioned .that Inder’s late partner had made good tho former shortage. Inder was ordered to to struck oft the rolls. Costs amounting to £lO 10s were allowed tho society.
