i—■ —«1 Test Trial Of Young Biologist FOR TEACHING DARWINIAN THEORY. [By Electric Cable—Copyright.! [Aust. and N.Z. Cable Association.! (Received Wednesday, 7 p.m.) NEW YORK, July 7. A message from Dayton, Tennesso, states that the two thousand population of this rural town is expected to be augmented five-fold temporarily, during the trial, beginning on July 10, of John Scopes, a young teacher of biology, who will be charged that ho taught the Darwinian theory of evolution, in violation of the roeent Tennessee Statute forbid ing instruction on matters contrary to the letter of the Bible on the subject of Creation.
Scopes voluntarily submitted himself to arrest for the purpose of testing the validity of the Statute, which, he alleges, violates the fourteenth Amendment of the Constitution, forbidding the abridgement of privileges and immunities or the deprivation of liberty or property of a citizen of the United States by individual States. _ An imposing array of counsel, including Mr Clarence Darrow, of Chicago, who defended Leopold and Loeb, and Mr Bainbridge, Secretary of States in President Wilson’s Cabinet, contend it is impossible for Scopes to exclude evolution in teaching biology and the prohibition of such imperils his livelihood. A number of eminent scientists are expected to testify to the truth of the theory. The prosecution is headed by Mr William Jennings Bryan, In conjunction with prominent Churchmen, who are working for legislation against the theory in all States.
