Wellington, Dec. 9. Hie Honor Mr Justice Button and a speeial jury, to-day heard the case in which Kichard Elliot, a baker, sued the City Council for £500 for injuries received in a tram accident on the Brooklyn line last May. The Council had paid £65 iuto Court in satisfaction of plaintiff's claim, and contended that plaintiff was exaggerating his injuries. The jury awarded £250. A new trial is to be moved for on the ground that the damages are excessive.
