RIGHT-HAND RULE.
MAGISTRATE'S VIEW. Doubt as to the application of the right-hand rule where one road meets another to form a T, as distinct from the intersection of two roads to form a crossing, was raised before Air H. P. Lawry, S.M., recently, in the Magistrate’s' Court at Palmerston North for'a ruling. Defendant was C. A. Mackie (Mr T. M. N. Rodgers), who was charged on an information laid by Inspector M. J. Hartigan that, being the driver of a motor-ear approaching the intersection of George Street and Main Street, Palmerston North, to which a vehicle was approaching on his right, so that if both continued on their course there would be a possibility of a collision, he failed to give way to such vehicle and allow it to pass before him. The circumstances related were that defendant was proceeding from George Street and turned into Alain Street toward the Square. The inspector at the same lime was proceeding along Alain Street toward the Square, both cars arriving at the George Street intersection at the same time.
In ' a reserved judgment delivered to-day the Alagistrate held that the motorist in the position of defendant had to observe the right-hand rule. The Alagistrate reviewed the legal authorities on the point at some length and stated; “What might be termed the ‘give-way’ motorist might have said that this was not a vehicle approaching on his right, but he could not 6av that it was not crossing on his right.” Costs only, 12s, were entered against defendant.
