MAGISTRATE’S COURT

DEFENDED CASES. Mr H. P. Lawry, S.M., presided at a sitting of the Magistrate’s Court to-day. E. F. Voitre (Mr A. M. Ongley) proceeded against A. Teuton (Mr L. Laurenson) for £1 10s lid, the balance of an amount set as half the cost of erecting a boundary fence. Defendant (who paid £9 into Court) claimed tha.t he had specified £9 as his halfshare of the cost. Judgment was given for defendant. A. W. Yortt (Mr M. IT. Oram) claimed £lO 13s 6d from N. V. Batt, of Shannon (Mr H. It. Cooper) as damages for a motor accident in a race-day line of traffic near the Awapuni racecourse. Plaintiff stated that he had to stop his car suddenly and defendant’s car hit his from behind. Defendant said he could have stopped his car had plaintiff signalled. Giving judgment for plaintiff, the Magistrate said that in such circumstances a motorist had to be prepared to stop within a foot or two.
