COMMISSION CLAIM
JUDGMENT FOR PLAINTIFF. Claiming £4O allegedly due as his share of the commission from the sale of the lease of the Princess Hotel, M|Hh'ani Conaghan, land agent,, of Palmerston North, took proceedings, before Mr H. P. Lawry, S.M., in the Magistrate’s Court, yesterday, against M'almanche and Co., land agents, of Dannevirke. Mr A. M. Ongley appeared for the plaintiff and Mr P. W. Dorrington for defendants. Plaintiff alleged that, under a vetbal agreement entered into in 1936, he and defendants agreed to share equally commission earned transaction effected by tho two of them in conjunction. Defendants, plaintiff said, had received £l3O in commission from the Princess Hotel deal. Plaintiff was holding a £SO deposit on an hotel in'Wanganui and admitted, that defendants were to a half share of this. After making this deduction, he claimed £4O from defendants as half of the other de&l.'
Defendants denied that plaintiff had been instrumental in introducing them to tho purchaser of the Princess Hotel lease, or that they had acted in conjunction on that deal. After'reducing the claim by £4, half the expenses incurred by defendants in the transaction, tho Magistrate gave judgment for plaintiff for £36, with £2 15s costs and £4 3s for solicitor’s fee.
