RECOVERY OP MONEY. Per Press Association. WELLINGTON, Oct. 31. Holding that Gladys Ivy Cudby must have known that the moneys given her by her husband were the proceeds of housebreaking by him and his brother, Mr J. Miller, S.M., gave judgment m favour of four plaintiffs claiming from these three defendants moneys allegedly stolen by the brothers and received by the woman, she knowing them to have been wrongfully obtained. Plaintiffs were Thomas It. Richards, suing for £27; Arthur Edmondson, also for £27; Walter George Ross, £8 7s; and George Campbell Clarke, £5. Judgment was for the full amount in each case. Mr Miller reviewed the whole of the plea made by Mrs Cudby as to innocence of wrongdoing by her husband and dealt lengthily with references to thinking her husband was a bookmaker, which was in conflict with her other statements of his making money by betting with bookmakers. From this and the fact of her knowing her husband’s past, and the fact that he was out late at nights and handing over considerable sums of money, there was a strong presumption that she knew the moneys were stolen.. She must have known she was receiving moneys from her husband in his continued career of crime, and in this way she lent support to this career, participated in the gains and associated herself in a scheme of crime. Judgment was entered, as prayed for, against her separate estate.
