CLAIM FOR DAMAGES
IMPORTANT LEGAL ASPECTS. Per Press Association. BLENHEIM, Dec. 8. In the Supremo Court, before Mr Justice Blair, there was commenced a civil action which will have important legal aspects before finally being disposed of, and by. arrangement these will be dealt with in Wellington, the jury in Court having only to decide two points—whether the accident, which was the basis of the claim, occurred through a bicycle slipping on the rails of a private siding, and what measure of damages the plaintiff had sustained, all other aspects being left for argument later. Plaintiff is Andrew Wilson, of Blenheim, and the defendants the New Zealand Loan and Mercantile Agency Coy., Ltd. The statement of claim set out that on August 28, 1931, plaintiff was totally disabled as the result of an accident in Sinclair Street, when his bicycle was upset through contact with one of the rails of a railway siding leading to the company’s stores. Plaintiff claimed special damages, 63 weeks’ wages at £2 15s per week (£173 ss), hospital and medical expenses £lll 3s, and general damages £ISOO. The total claim was thus £1784 Bs.
The jury returned a verdict for £784 3s, and the case was adjourned sine die for legal argument in Wellington
