ACTION BY “WIZARD” SMITH. SYDNEY, Oct. 13. Further evidence was heard to-day in the case in which Mr Norman (“Wizard”) Smith claims £20,000 damages from Smith’s Weekly for alleged libel in an article published on May 21, in which plaintiff contends he was publicly denounced as a coward in connection with his motor speed trials on Ninety Mile Beach, New Zealand. The defence pleads not guilty, and further contends that the articles was “truth and for the public benefit.” Plaintiff was cross-examined by Mr Watt, K.C., for the defence, who ascertained that Mr Smith had received certain sums for information supplied to a section of the Press, but Mr Smith refused to say how much. Mr Watt insisted that the amount should be stated, and declared that it went to Mr Smith’s credit. Mr Watt added that he desired to prove that Mr Smith got more than £IOOO, which was a very good reason why he should stage a fiasco. Mr Smith said ho had a letter agreeing to pay him £IOO, of which £SO had been paid. Mr Watt questioned plaintiff at length about the fire in Mr Smith’s car and the conditions on Ninety Mile Beach, also about attempts on the fivemile record. The hearing was adjourned.
