MAGISTRATE’S COURT.

BREACHES OF BY-LAWS. 'Mr J. L. Stout, S.M., presided at the sitting of the Magistrate’s Court to-day. Charges of having no reflector on his motor lorry and of failure to possess a heavy traffic license for the vehicle were brought by the Ivairanga County Council against J. G. Elwin. Defendant pleaded guilty to both charges, fines of 10s and 40s respectively being imposed, with 10s costs in each case. For cycling on footpaths R. Zaloum, H. Campbell, G. Pike and I. Wilson were each fined 10s, with 10s costs. For a similar offence J. A. Mitchell, who appeared voluntarily, was penalised 10s, with 3s costs. Jack Smith pleaded guilty to receiving into a passenger carrying vehicle a greater number of passengers than it was licensed to carry.—lnspector Smith said that he had found three adults and six children in the veliicle, which was licensed to carry three persons besides the driver. A fine of £l, with 10s costs, was imposed, THE RIGHT HAND RULE.

A charge of failing to give way to traffic approaching from the right at the intersection of Main and Ruahine Streets was preferred against Stanley Baker. ■ Mr Gordon appeared for defendant, while Mr Rutherfurd conducted the case for -the City Council traffic inspector. Traffic Inspector Smith stated that on May 20 he had been summoned to the scene of an accident at the intersection. He testified to the positions of the vehicles, of which defendant’s was one. Evidence was given bv C. Christenson, Kate E. Scroggs, H. E. Cole and S. H. Snell Defendant stated that he approached the intersection at a speed of less than 15 miles an hour, and gave warning. He was well on to the intersection when he saw. the other vehicle, which was first travelling at a reasonable speed and then came with a rush. It appeared that the driver had put Ids foot on the accelerator instead of the brakes. The magistrate decided that defend ant had failed to observe the right hand rule. A fine of £5, with £1 2s costs was imposed.
