SETTLEMENT EFFECTED.
WIFE RECEIVES £6OO. CLAIM AGAINST HUSBAND. The fact that a satisfactory agreement had been arrived at between the parties was announced by Mr Cooper when the case in which Harriet Jane Iviaskery (Mr James, Wellington) proceeded against her husband. Leonard Alaskery, for moneys alleged loaned to her husband, was recalled in tire supreme Court at Palmerston North on Thursday. The claim was for £316 as half the selling price of a cake shop business in Cuba Street in the joint names of the parties, and £312 allegedly due to the plaintiff under the terms of a deed of mutual separation. Mr Cooper, on behalf of defendant, said that it had been agreed that plaintiff would accept £6OO including the costs of the action. In advising liis client to agree no liad pointed out that no good purpose could be served by a lengthy cross-examination of the parties, m the course of which a certain amount of “dirty linen” would be washed. Counsel's opinion was that the amount involved was not sufficiently large to wurrant his carrying the case any further. He was satisfied in his own mind that the maintenance money should be paid. His Honour the Chief Justice, Sir Michael Myers, who presided, said that the settlement seemed to be a satisfactory one. Mr Cooper: It should be pointed out that defendant denies the allegations made against him by plaintiff. His Honour: If any of those matters were relevant, I should have had to hear all the evidence before coming to any settlement. The case should be settled on points of law. Regarding divorce proceedings which are contemplated between the parties, and the hearing of which was set down for Thursday, Mr James pointed out that it was necessary for him to get a witness from Auckland and one from Feilding. Mr Cooper said it was proposed to ask His Honour to make a definite fixture for the hearing of the divorce proceedings at the Supremo Court in Wellington. Mr Janies said he would do everything in his power to expedite an early fixture. His Honour fixed Thursday, May 22, as the date.
