CROWN’S RIGHTS.
UPHELD BY JUDGE. Per Press Association. AUCKLAND, Sept. 8. The immunity of the Crown from counter claims in legal actions was upheld by Mr Justice Stringer at the Supreme Court. The Government Forest Service claimed £750, the cost of 25,000 seedlings supplied to the New Zealand Redwood Forest, Ltd. The company, counter-claimed for £llsO damages on the ground that the contract for half, a million seedlings had not been fulfilled.
Mr Paterson, for the Government, said that every endeavour had been made to settle the case, but the unreasonable attitude adopted by the company and the special circumstances of tho case had resulted in the department standing strictly on its rights. His Honour said that the Crown’s objection must prevail. The Crown Suits Act stated that.
