VERDICT FOR DEFENDANT

DANNEVIItKE, Feb. 9

In the case Inspector of Awards v. Mrs Franklin, a claim of £500 for alleged breach of the "Wellington Shearers' award, effected it is alleged by locking-out certain shearers on November 4, 1909, judgment was given to-day. The case turned'on the right of the men to decline to shear sheep they alleged to be wet. Mr McCarthy, S.M., in a lengthy judgment, held that the sheep were dry, and the object of defendants' manager was not to force the men to comply with an order inconsistent with the terms of employment, but he was merely insisting on the men obeying a reasonable command.

Judgment was given accordingly with costs against plaintiff.
