Alleged Horse-Stealing.

At the S.M. Court this morning, before Mr J. E.. McMillan, J.P , Charles Dunn (Mr -Gould), late ot* Palmerston but now of Pahiatua, farmer, was charged with the alleged theft of three draught horses, the property of Mads Mikkelsen, Te Kapua, for whom Mr Innes appeared. Prom facts detailed by counsel for the prosecution it appeared the wire fence j-urrounding the paddock where the horses were grazing, was cut about .3 o'clock one morning, and the horses were seen being driven along the Pahiatua track at five o'clock on the same morning. They were recovered from accused ten miles from Pahiatua. A remand was asked for by Mr Innes to procure the attendance of the prosecutor. Counsel for the defence objected to the adjournment, adding that he was prepared to admit the horse had been taken, not by the accused, but by Thomas Powell, on behalf of his brother, Joseph Powell, who had purchased them. The facts of the case, he said, were known to counsel for the prosecution. Mr Gould expressed the opinion that in bringing the case at all the criminal process of the law had been greatly abused. A remand was granted till Mondaynext, Mr McMillan pointing out he hadno jurisdiction by himself, another justice being necessary before the case could be heard. Accused was liberated on his own recognisances of £50.
