IMPORTANT CASE.
The New Zealand A Occident Insurance Company lately contested a claim for £500 due on a policy issued to one Roderick M'Millan, who died from a gunshot wound m Gippsland, Victoria, on 6th .November, 1882. On that date the deceased, who was clerk and engineer for the Taralgon Shire Council, wont with a friend to look for a horse, carrying a gun m case thoy might find some game. Coming to a river they proposed to bathe, and McMillan's companion turned back to a cottage to borrow a towel. He had not gone far, however, when he heard the report of a gun, and on returning to the spot where h<* had left M'Millan he found him lying dead across a fallen tree, with a gunshot wound m his forehead. The defence was that the deceased had committed suicide, m which case the policy would be rendered void. Evidence vyas adduced to show that the deceased had misappropriated the funds of the Shire Council an » that the auditor was to inspect his books on the day of his death, when his defalcations must be discovered. The jury returned' a verdict for the plaintiff— deceased's father — for the amount claimed with £30 10s interest
