THE JURY DISAGREE.

NEW TRIAL ON MONDAY.

PALMERSTON N., June 3. The case <aS alleged robbery-under-arms against Pawelka was heard yesterday.

Evidence was given by the Kendalls, who said that they recognised Pawelka as their assailant.

The accused was the only witness in defence, and confined himself to saying that he was not there and knew nothing of the occurrence. The defence was practically an attempt to cast doubt on the truth of the Kendalls' story. The jury, after five hours' retirement, disagreed, and a new trial is called for Monday.
