A CATTLE DEAL.
CLAIM FOR DAMAGES'. f At the Supreme Court yesterday before Mr Justice Herdman, an action for damageß was commenced, the plaintiff being Frederick Mullins Amor, who claimed the sum of £302 8s from William Shipley on a cattle transaction. Mr 0. S. Thomas appeared for the plaintiff and Mr M. J.Xlresson for the defendant. ' * The statement of claim was to the effect that on May 26, 1919, William Shipley, farmer, of. Christchurch, had entered into an agreement to sell 59 head of cattle to Frederick Mullins Amor, farmer, of Christchurch, under a forward delivery contract at £l3 per head. Delivery was ‘to be taken on vendor’s farm at Longbeach in the first ‘week of October, 1919, a condition be- •' ing that vendor should treat the cattle in a husbandlike manner and Bpt put ‘more cattle on the property. Plaintiff ■proceeded against Shipley for £302 Ha damages on the grounds that defendant did not treat the cattle in a husbandlxke manner, and as a result they deteriorated and became of les9 value at the time of delivery. As a result of this deterioration plaintiff had to hold the cattle and graze them in order to tell them at a reasonable price. The defence was a general denial of the statement of claim. The hearing of the case was not concluded when the Court rose for the day.
