A REMARKABLE BANKRUPTCY
——V TO TUB EDITOR. Sir,—Under the above heading, I read with no surprise a report of the proceedings which took place at the Supreme Court, Christchurch, in the matter regarding J. S. Mycfs f s application for discliargo. I think that overvono who read that statement felt that the" bankrupt deserved the language used by the . Judge, “ The bankrupt had used the machinery of the Court as a means of endeavouring to perpetrate a fraud.” Now, had you given as full a report of the proceedings which took place at the Magistrate’s Court, on Sept. 22, you would have been fair to the bankrupt. I can say positively that your report was a misrepresentation of the facts of the case. It was proved by witnesses that J. S. Myers was not put on oath at his meeting of creditors. He also stated that he was never pub on his oath at anv time. It was also proved by witnesses, and ■ afterwards admitted! by the Official Assignee, that the meeting of creditors was adjourned sine die, so as to enable the Official Assignee to obtain legal advice in respect to the validity of the mortgage. There was no, other meeting of creditors, the Official Assignee having entered into an agreement with the mortgagee to receive 20s in the £ and expenses as the equity of redemption. The mortgagee received the property, although the estate did not pay 20s in the £. Hence the proceedings at Court on Sept. 22.—1 am, etc., GEO. COX.
