Occasional vacancies how to be filled,up. \ 23. If any vacancy. shall occur ,in the Town Council, other than in the manner and at .the times hereinbefore specified, such vacancy shall be filled up by an election to take place on some day to be fixed by. the Retiirniug-Officer within 14 days after such vacancy {shall liave been made known to him by the Clerk of the Council, (who is hereby required forthwith to make known the same); and the nominations of candidates shall be sent to the Returning-Officer, in the manner hereinbefore provided in the case of an ordinary vacancy, at least 6 days and shall be published iy-him at least four days before the day of election ; and every < member so elected shall hold office until the time when the person in the room of whom he was chosen,-would in regular order have gone out of office. Members capable of re election. 24. Every member of the Town.Council vacating his seat shall be capable of re-elec-tion, immediately, or at any time thereafter, unless he shall be disqualified from sitting in such Council. Occasional Vacancies how they may occur. 25. In case any member of the said Tqwji Council shall resign his seat by writing un,der his hand addressed to the Clerk of,the Council, or shall be absent from the said town or suburbs for more than two months, or shall become bankrupt or insolvent,,or shall compound by deed .with his creditors, or shall have become a public defaulter, or shall have been convicted of any treason, felony, or other infamous crime, or shall have become of unsound .mind, his seat in the said Council shall, ipso Jhtcto, .become vacant, and shall be filled up by a fresh election ; provided that any person so vacating bis seat by reason of absence, or resignation, and any person having so become bankrupt, or or having com-po-inded by deed with his creditors, who shall have obtained his certificate, or shall have paid his debts in full, shall be capable of re-election. Cases of disputed elections or Vacancies. 26. If any question shall arise as to the validity of any election, or as to whether any vacancy has occurred, the same shall be referred by writing to the Superintendent ami Executive Council of the Province, and the decision of the Superintendent, with the advice of his Executive Council, conveyed by writing, addressed to the clerk of the Tovm Council, shall be final. Powers of Town Council. 27.
