BYE-LAWS OF THE CHURCH PROPERTY TRUSTEES,
For ike constitution ofgTarishes within the Canterbury Settlement*} for declaring the number of Trustees to tp'elected and nominated for each Parish f'and for regulating such 'election and nomination : adopted at a meeting of the Trustees held in the School Room, at Christchurch, on the 7i/i of December, 1854. I. Until further provisions be made in that behalf, the Canterbury Settlement shall be divided into the following Parishes: — 1. The Parish »f Ljttelton. j 2. The Parish of Governor's Bay. 3. The Parish rf Akaroa. 4. The Parish of Kaiapoi. 5. The Parish of Christchnrch. The boundaries of such Parishes shall be as follows : I. The Parish of Lyttei/ton shall comprise all that portion of the Canterbury Settlement included within a boundary line commencing' at a point where the eastern boundary of the Native Reserve at Raupaki meets the sea, thence runningl akin** that boundary to the north-east comer of the Native Reserve, thence in a north-easterly direction along the ridge of the hill to the flag staff on Mount Pleasant, thence in a straight line to the old Ferry, thence along the sea coast to the starting point. 2. The Parish of Governor's Bat shall comprise all that portion of the Settlement included wiihin a boundary line commencing at. a point where the south-west boundary of the parish of Lyttelton meets the sea, thence running along: that boundary to the north-east cori).sr;pf the Native Reserve, thence along the ridee of the hills to the highest point of the jSmcalled Cooper's Knobs, thence in a straight line to the puint where the river Halswell enters Laice Ellesmere, thence along the shore of that Lake and the sea coast to the Little River, thence along the Little River, Lake Forsyth,. and the northern branch of the Little River to its head, thence by a straight line northerly to a point half way between the east head of Port Levy and the west head of Pigeon Bay, thence by the sea coast to the starting point, including also Quail Island. 3. The Paeish of Akaboa shall include all that portion of Banks's Peninsula, lying to the south and east of the Parish of Governor's Bay. 4. The Parish of Kaiapoi shall include all that portion of the Canterbury Settlement lying nortli.of the river Waimakariri, and north of a line ruuriing due"west from the source of that to the west coast, and north of a straight line drawn from Trig. Pole, No. 19, on the south bank of that river, to Trig. Pole No. 27 on the sea coast. 5. The Pabish of Christchuech shall comprise all that portion of the Canterbury Settlement which is not included in any of the above mentioned Parishes. 11. The number of lay Trnstees to be elected and nominated for the several parishes respectively, shall be as follows :— 1. For the Parish of Lyttelton, two elected and two nominated Trustees. 2. For the Parish of Governor's Bay, one elected and one nominated Trustee. 3. For the Parish of Akaroa, one elected and .'.'one nominated Trustee. 4.: For the Parish of Kaiapoi, one elected rind one nominated Trustee. "5. For the Parish of Christchurch, four elec- ,. ted and four nominated Trustees. .^.lll- For the first annual election of Lay Trustee?, the delivery of the rotes shall take place, on the 22nd, 23rd, 24th, 25th, 26th, and 27^jdays of January, 1855, and the declaration/of the elections on the 29th day of that month ; and for all subsequent elections the '< delivery of the votes shall take place on the 26tli^27th, 28th, 29th, and 31st days of December in each year, and the declaration of the election on the first day of January of the year . eniiayig. ration of election,by letter addressed to the Incumbent of any Parish, propose himself or any other duly qualified person to be a candidate for the office of Lay Trustee for such Parish, and the Incumbent shall, 14 days at least before the day of declaration of election, publicly notify the "names of the persons being duly qualified who have been so proposed as candidates, and shall at the same time also publicly notify some one or more houses within the Parish at which the voting papers hereinafter mentioned may be delivered, i V. The electors within such Parish shall, during the days hereinbefore appointed for the delivery of the votes, deliver such votes or cause the same to be delivered, on voting papers in the form annexed to these Bye-laws, at the house or houses appointed for their reception by the Incumbent. VI. On the day appointed for the declaration of the election, the Incumbent of each Parish, together with the Lay Trustees for that Parish, or iv their absence with one or more Laymen appointed by himself, shall ascertain the number of votes which shall have been given in favor of each candidate, and shall make a written declaration of the names of the persons elected as Trustees. Incase of an equality of votes in favour of two or more candidates, the Incumbent, together with the lay assistants, shall decide by lot which o£ the said candidates shall be elected. At the same time and place the Incumbent shall declare in writing the name or names of the person or persons whom he nominates to the office of Trustee. Within three days after such day of declaration of election the Incumbent shall cause such written declarations to be publicly notified as hereinafter provided, and shall likewise transmit copies of the same to the Bishop or Chairman of the Trustees. VII. Any disputed question with reference to any such election, which shall arise before the termination thereof, shall be decided by the Incumbent, subject nevertheless to an appeal to the Trustees. Any objection to the validity of ' any election or nomination shall be decided by the Trustees^ Provided always that no such appeal or objection shall be entertained, unless notice thereof in writing be given to the Bishop or the Chairman of the Trustees, within one. calendar month from the day of declaration of election. The voting papers used at any election shall be preserved by the Incumbent for three calen- , dar months after such election, and shall, at. reasonable times and places, be shewn on demand to any person resident within the Parish, and duly qualified to vote at such election. ' VIII. Every public notice required to be '' given under these Bye-laws shall be so given by.affixing such notice to the principal door of the building or buildings commonly used for the purposes of Divine Worship in the Parish to which it refers, and likewise where practicable, by publishing the same in one or more newspapers within the Province. FOKM OJF VOTING PAPER.* I, (A.8.) declare that I am a communicant of the Church of England, and duly qualified, according to the Church Property Trust Ordinance, to vote at elections of Lay Trustees for the Parish of , and I hereby vote for the election of the following persons to that office. Names of Candidates -j ' Signature of Elector N.B. This voting paper will be void, if it shall contain the names of more persons than there are Trustees to be elected for the Parish to which it relates ; or if it is not in other respects filled up and delivered in accordance with the Bye-laws relating to the election of Trustees. No vote can be received in favour of a person who has not been regularly proposed as a candidate. • Printed voting papers may be obtained on application to the Incumbents of the respective Parishes.
