In the appeal case Fitzpatrick against police, where the defendant, a bookmaker, had been fined £75 fcr betting with an infant, the Chief Justice dismissed the appeal, holding that the onus of proof of age was on the defendant. His Honour refused any mitigation of the fine, adding, however, that the appellant might apply to the Crown authorities for a remission of the fine, which certainly seemed heavy. The youth in question was twenty years of age and might have been mistaken for one over.
