" FOR “ BRUTAL ASSAULT.” [By Telegraph, Per Press Association.] , AUCKLAND, January 18. ! Leniency was shown A. H. Driscoll, a jockey, and E. W. Leyden, the two men who had admitted the. sensational assault 1 at Green Lane, shortly after midnight oil Boxing Day, hy Air ,W. R. McKean, S.AI., this afternoon. According to Air Singer j counsel for the two men, in ah earlier hearing, Driscoll .would be deprived of Ms jockey’s license through a conviction. The assault was admitted, but Air Singer contended that there was provo> cation. At tprday’s proceedings the Magistrate said lie was taking a very lenient view of the case. Re would adjourn the case for six months. Concluding he said: “During this period, if the conduct of Driscoll and Levdon is satisfactory, I will dismiss the information, without recording a conviction. . Out of good natue, the two- persons .assault-’ ed have said that they do not want compensation. One was severely hurt, and ,1 shall insist on compensation.” Air McKean ordered Driscoll and Leydon to pay £lo. into Court. The money will be apportioned .to the victims of tlie' assault.'
