ADELAIDE, Dec. 18. Sir Henry Harwell, cs-l’reniicr. has been elected to 1 1 to vacancy in the Federal Senate, caused by the death of Snator O'Laghlin, delcating a Labour candidate hv 31 votes to mb WAI.SII AND JOHNSON. SYDNEY. December IS. The reasons actuating the High Court in ordering the release of Messrs Walsh and Johnson from custody were announced to-day. All the Judges were unanimous in expressing the opinion that the Commonwealth cannot provide for the delorlation of citizens who were in Atistralia before the inauguration of the federation in 11)111. The Court, v.as of the opinion that such citizens could not he translormcd *nto immigrants for the purpose* of the Immigration Act. under which the
leporlalimi proceeding- were initialed. A> Mr Walsh arrived in Australia in 18!)2. he was released for this reason. I'hc Act, however, did not extend to
persons arriving in Australia since l<;t)l. including Johnson, hut. he was released, because it is necessary before any person could lawfully he required to show cause to a Board, or sutler deportation, he should he informed, with reasonable definiteness, of the particular acts for which the Minister proposed to deport him. No such information was according to the evidence, given before the High Court, il ever given.
