UNUSUAL CASE.
CLAIM AGAINST ORCHARD INSPECTOR.
(BY TELEGRAPH — PRESS ASSOCIATION.) AUCKLAND, Oct. 5. Conclusion was reached to-day in the case under the Orchard and Garden Diseases Act, 1909, in which George Herbert Guy, a linotypist, and tEe owner of an orchard at Henderson, sued John W. Collard, inspector of orchards at Auckland. Plaintiff claimed that between February 17 and March, 1922, defendant wrongfuily _ut down 175 "fruit trees in "his orchard, and therefore diminished the value of the land by not less than £400, for which amount and £50 general damages judgment was sought; The jury, after half-an-hour's retirement, returnecT a verdict in favour of defendant. They found that plaintiff had not done all that was necessary to eradicate disease from his orchard or prevent the spread of disease, and that the measures taken by defendant were necessary to eradicate the disease.
