OVERSEAS CONCERT

The proceeds of the smoke concert to be held to-night by the Overseas Club will be given in aid of the Overseas flotilla. The concert will" doubtless be largely attended. MAGISTRATE'S COURT. WEDNESDAY, MAY 23. (Before Mr W. R. Haselden S.M.) ASSAULTING A CONSTABLE. Joseph Chamberlain and Aloys Mathes, two Swiss, were charged with assaulting Constable Liston and doing him grievous bodily harm while in the execution of his duty at Kaponga on1 Friday, 18th instant. Mr Sitewart appeared for the accused, who pleaded not guilty, and elected to be tried by a jury. Constable Liston gave evidence that while taking a man named Lynch (whom he had arrested on a charge of being drunk while in charge of a motor car and using obscene language) to the lock-up, the two accused interfered with him and started punching him, breaking one of his ribs. G. Paterson and P. Pitcher gave evidence that they went to the constable's assistance, and corroborated the evidence as to the assault. Dr. Buist gave evidence that Le bad j examined the constable after the assault, and found one of his ribs broken. The accused were committed for trial at the Supreme Court, New Plymiuth bail being granted, each in their ov n recognaisance of £100, and each in one surety of £100. MISCELLANEOUS. An application for a change of venue to Palmerston North in the case ot J. Thomson v. Reid and Gray, was granted. . .
