IN Pursuance of the powers and authorities contained ia "The ' Counties Act, 1908," "The Public Works Act, 1908," and "The Motor Regulations Act, 1908," and of all and every other, the powers, provisions, and authorities in that behalf contained in any other Acts or otherwise possessed by or vested in it, the Councils of the Counties of Hawera and Waimate West hereby make, by way of special order, the following By-laws for the Hawera • and Waimate West Counties. PART I. # INTRODUCTORY. REPEAL.. . 1. All By-laws heretofore made by the Counties of Hawera and Waimate West are hereby repealed. DIVISION OF BY-LAWS. - 2. These By-laws are divided into six parts, numbered 1 to 6 inclusive, , each of which parts is divided into sections. The schedules appended to these By-laws shall be deemed to form part thereof, and slight deviations 1 from the forms prescribed but to the • same effect and not calculated to mislead shall not vitiate them. / INTERPRETATION. 3. In these By-laws, if not inconsistent with or repugnant to the contexts— "Cattle" means and includes any ,; horse, mare, gelding, rig, colt, filly, ass, mule, bull, cow, ox, heffer, steer, calf, sheep, ram, ewe, wether, lamb, goat, kid; and pig of any kind. "Chairman" or "County Chairman" means the Chairman of the Hawera ■ or Waimate West Counties as the case may be. "The County" means the Hawera or Waimate West County as constituted under ' 'The Counties Act, 1836." ■■ - ■• ;; " "The Council" means the Hawera or Waimate West County Council. "County Engineer or "Engineer" means the Engineer of the County. "County Clerk" or "Clerk" means the Clerk of the Haweni or Waimate West County "County Road" means any road, bridge, ferry, or ford under the care, control, or management of the Council of the Haweni, or Waimate West Counties. 4 'Footpath" means a space formed or set apart on the side of any road or street or elsewhere for the use of foot passengers. "Heavy Traffic" shall have the meaning assigned to that expression by section 139 of "the Public Works Act, 1905." "Inspector" means any officer for the time being appointed by : the County Council for the purpose of inspecting traffic on roads. "Motor Waggon" shall be deemed to mean and include any engine or machine engaged in "heavy traffic" as before defined propelled by steam, electricity, gas, or any other motive or mechanical power whatsoever used for the purpose of conveying goods and materials on the engine itself, but shall not include motor cars or motor cycles used only for carrying people. "Offence" means an offence against any of these By-laws, and includes the omission or neglect to comply with any part thereof. "Person" includes any incorporated company or body. "Public Place" means and includes every road, street, footpath, court, alley, thoroughfare, of a public nature open or used by the public as of right, and every reserve and place of recreation or resort so open or used within the County. . "Road" or "Public Road" means any highway, road, street, thoroughfare, or way of public nature, or iised by the public as of right within the County. "Traction Engine" includes any locomotive engine propelled by steam or other mechanical power when not used on a railway or tramway, but does not include a motor car or cycle. "Trailer" means a vehicle intended to' be drawn by a motor waggon. "Vehicle" means and includes every coach, carriage, omnibus, drag, cab, cart, dray, waggon, timber carriage, lorry, van express waggon and any other conveyance whatever its construction, and whether drawn by animals or otherwise." "Owner" of any vehicle, traction engine, motor, horse, or other property or chattel, includes a bailee entitled to the possession and use or profit thereof. "Driver" means and includes every person for the time being in charge of any vehicle, engine, or motor, or having any authority in connection with the immediate control thereof. "Motor" shall have the meaning assigned to it by Section 2 of "The ( Motor Regulation Act, 1908." Words importing the singular number include the plural number, and words importing the plural number include the singular number, and words importing the masculine gender include females. PENALTIES. 4. Any person offending against any of the provisions of these By-laws or any section, sub-section, or part of a section, or failing to comply with any condition therein, or guflty of any ■: omission or neglect respecting anything .contained therein, or m; any, section; ... .subrsection, or part of a .section thereof j - shall be guilty of an offence, and shall, except as herein otherwise provided, ■ for every such offence, whether by act, neglect, or omission, be liable to a penalty not exceeding £5. PART IT. HEAVY TRAFFIC AND WIDTH OF TYRES ON WHEELS. 5. The minimum width of the tyres of all wheels of any cart, dray, waggon, coach, or other vehicle( whether plying for hire or not), brought or used on the roads in the County, shall be regulated in proportion to the weight of the load which such cart, dray, waggon, coach, t ~ or other vehicle shall carry, according to the scale set forth in the First Schedule hereto. 6. For the purpose of computing the ■weight of the load on any cart, dray, wjaggon, coach or other vehicle mentioned in the preceding paragraph to the extent to which such cart, dray, ■waggon, coach, or other vehicle is carrying any one or more of the materials and things mentioned in the . Second Schedule hereto, the measurements and quantities of such materials and things respectively enumerated in the said Second Schedule hereto shall lac deemed to be of the respective weights specified to such respective measurements and quantities in the ■said Second Schedxile. 7.
