HAWERA R.M. COURT.

(Before C. E. Eawson, Esq., R.M. ASSAULT.

W. Holdway v. E. Butler. This was a oase in which defendant was charged with assault and battery. He was bound over in his own recognizance to keep the p9ace.

INDECENT LANGUAGE.

A. McCallister was charged with using indecent language in a public place, and with resisting the police in the execution of their duty was sentenced to be imprisoned with hard labor for 14 days.

J. Milford v. H. Southey. — Judgement summons, 3s Bd. Ordered to pay £1 per month, first instalment on or before 9th June, in default the whole to become due, and defendant to be imprisoned for 21 days.

O. H. Stott v. D. McGregor.—Judgment summons ; amount, £49 183 7d. Ordered to pay £5 per montb. First payment on or before the 10th June next, or in default to be imprisoned for two calendar months.

Hawera District Building Society v. R. Mumby.— Claim, £18 14s 6d. Judgment by default.

Counell v. P. Dolan.— Claim for £6 lOs, commission. This was a claim ior commission on the sale of the Otakeho hotel. Mr. Barton for defendant, Mr. Hutchison for plaintiff. The claim was based on the fact that an offer had been made by a client of Connell's, and that Dolan, the owner of the hotel, said he would write to the said client. Defendant was also in treaty with Mr. Moss, late of the Woodville, an hotel tit Alton, and ultimately sold the lease to the latter, and paid commission to W. Cowern, through whose agency the sale of the lease was effected. A letter which Dolan said he had written to Connell's client appeared to have miscarried. After hearing evidence, including that given by Connell's client, Mr. Grylls by affidavit, in which the latter said he was not prepared to accept Dolan's terms, judgment was given for defendant, with costs against plaintiff, the magistrate stating that there had evidently been no definite bargain made by Grylls, or by Connell on Grylls' behalf to accept Dolan's terms. The case occupied several hours.
