HAWERA RESIDENT MAGISTRATE'S COURT.
Thursday, September 23. (Before C. A. Wray, Esq., E.M.) J * NEGLECTED CHILDREN.
Henry Barston, who was arrested on warrant from Auckland, for neglecting to support his children in the. .Industrial School, was. brought before the Bench. The accused stated that he had been working with the unemployed on the Waimate Plains for some, time, but had to go to the Patea hospital. He was now working with Mr. D' Alton, native interpreter, and was willing to pay as much as he could. The case was adjourned for a month, in order to allow the accused to pay the instalments promised.
ASSAULTING AND THREATENING.
Jeremiah Flynn was charged by Sergt. Cahill with assaulting Michael Coonan, and threatening td fight William Collins, on the • 17th instant. Dismissed with a caution.
DOMESTIC TROUBLES.
Emma Vine charged her husband, Wm. Vine, with unlawfully and wilfully beating her. The- defendant pleaded not guilty. Mr. Barleyman appeared for plaintiff ; Mr. Parrington for defendant. The. plaintiff stated that on the 15th instant, she was ironing, and her husband came home,- and told her to leave ofL She did so. Her husband afterwards turned her out, and locked the door. The night was cold, and she had to sleep at a neighbor's place. -When turned out, she had only a skirt on, and she went to her daughter's place for some clothing. Cross-examined by Mr. Parrington— The land where the bouse is belongs to Mr. Croker. Witness paid the rent for
two months ; the rate being one shilling per week. Mr. Sisley put the house up. Witness.paid for it, but her husband supplied some of the timber. Witness refused to live with her husband, and would like to be separated from him. Witness did not care what happened, she would not live with her husband, because he illtreated her, and called her names which she did not deserve : she had never done anything that she need be ashamed of. jRe-examined — TZememberecL the agreement entered into at Mr. Barleyman's office between witness and her husband, in which he offered to allow her to live separately in the same house. ■ . William Vine, the defendant, stated that when his wife first left him, he tried to induce her to go back, but she would only consent, on condition that the house was built at Waihi. The defendant made a long statement as to the cause of the assault complained of, and stated that he did not put his wife out of the house. He had merely said to his wife that " there Was the door, or there was the bed." But in going out the door, he placed his hand upon her shoulder, and shoved her. The Bench said there was provocation on both sides, and it was absurd for them to come into that court to seek redress. They had their remedy in another court. ...The case would be uisnri&secL CIVIL OASES. Hone Pihama v. T. Quinlivan. — Claim for £17 Bs, for use of drays, and board and lodging. Mr. Barleytnan for plaintiff; Mr. Parrington for defendant. Judgment for £6 68, and Co6ts. A. Kelly v. A. Nathan and T. Quinlivan. ■tr-Claim for £19 7s, for carting. Mr. -Parrington for defendants. Adjourned till next court day. W. H. E. Wanklyn v. E. Dougherty.— Claim for £4 0s 2d, goods supplied. Judgment for plaintiff for the amount claimed, and costs. Whittaker Brothers v. J. N. Pope.— Claim for £2 17s lid. No appearance of defendant. Judgment for amount and costs. W. L. England v. E. Dougherty. — Claim for £1 14s 3d. Adjourned, in order to enable plaintiff to supply a lull bill of partieoiars; E. Sherrath v. W. Collins.— Claim for £15,' on an interpleader summons. Mr. Parrington for defendant. Adjourned till next court day. The court then adjourned.
