RE-TRIAL OF CASE AGAINST SYDNEY "TRUTH."

<By Telegraph-Press Assn.-Copyright.) (Rpceived This Day, 10.5 a.m.) SYDNEY, This Day. The re-trial of the ease of, Eden George versus Truth Newspapers, by order of the Full Court, resulted in a verdict in favour of George for £IOO,.

On an appeal by the newspaper "Truth," against the award to Eden Court ordered the action to be le-tried on the issue limited to damages only. The Court held that, taking all the circumstances of the case into consideration, the sum awarded was so excessive and so out of proportion to the damage suffered that it must be assumed that the jury had considered the matter from a wrong point of view. or under an improper understanding of their duty. Mr Eden George, formerly a member of the Legislative Assembly and sportsman, recently returned to Australia after living in America for several years. The newspaper asserted that he had defaulted in the payment of debts to the bookmakers before leaving Australia, and the jury awarded him £SOOO damages against Trutli.
