MOTION DISMISSED

Alleged Contempt (Received 24, 10.30 a.m.) SYDNEY, April 24. The High Court, without calling on counsel for the respondents, yesterday dismissed the motion brought by Eliot Valens Elliott for committal for contempt of Mr, R. G. Menzies, Federal Attorney-General and the editor of the “Sydney Morning Herald.” In the High Court on February 4 before Mr. Justice Evatt, Eliot Valens Elliott, who is a seani’an, sought a contempt order against Robert G. Menzies, Federal Attorney-General, and against C. Brunsdon Fletcher, editor of the “Sydney Morning Herald.” The application was based on statements by Mr. Menzies to a deputation from the Seamen’s Union on December 18 concerning the strike, and published in the “Herald” the following day. Eliot, claiming the publication prejudiced the case on the same matter on which the High Court had hitherto reserved judgment.
