Yesterday’s Conference FURTHER RESOLUTIONS Further recommendations from the executive were adopted by the North Island Motor Union conference in Napier yesterday as follows: — 11 That we approve the proposal to provide that regulations may be passed empowering any local body issuing a driver’s licence to revoke or suspend it if the person to whom it was issued becomes unfit to drive for any good reason. There is to be right of appeal to * Magistrate against any licence being so suspended or revoked and also against the refusal by a local body to -n-ant a licence to drive a public motor vehicle on the grounds of the alleged bad character of the applicant. 12 Ws agree to the proposal to provide that if a driver is refused a licence on grounds of lack of driving ability, he shall have right of appeal to the Minister, who may appoint a testing officer for the purpose of carrying out another test.

13 Prosecutions: That we agree to the proposal where a person is prosecuted for an offence against Section 28 of the principal Act or for the offence ot exceeding any limits of speed prescribed by regulations under the principal Act or prescribed in the by-laws of any local authority he shall not be convicted unless 'be is warned of the intended prosecution at the time the alleged offence was committed, or unless within seven days after the commission of the alleged offence a notice of the intended prosecution was sent by registered post to him or to the person who was registered as the owner of the motor vehicle at the time of the commission of the alleged offencej but failure to comply with this requirement shall not be a bar to the conviction of the accused in any case where the Court is satisfied that neither his name and address nor the name and address of the registered owner of the motor \ ehicle could, with reasonable diligence have been ascertained within the said seven days. 14 That wo approve tho suggestion to increase the penalty for the "hit and run" motorist from £2O to £lOO. 15 That we approve the proposal to provide that on conviction of an owner for his vehicle being unliceneed there automatically becomes due past licence fees and any tax on motor spirits used in the vehicle on which he may have - laimed refund for the period covered being that licence year during which the breech was committer. IB That we approve the proposed alteration to Section 32, subsection 2, to be extended so that information readily obtainable by owner as well as in his possession must be supplied on demand. 17. (a) Uniformity of euactmen.s dealing with road traffic. That we approve the following proposal. The power to make regulations conferred on the Governor-General by Section 36 of the principal Act is hereby extended to nclude power to make regulations for ,he control of any form of traffic other 'than motor traffic in so far as in the opinion of the Governor-General the control of such traffic is neeessa-y tor the uxoper regulation of motor • raffle, (o) Without limiting the extent of the power conferred by the last preceding subSection it is hereby expressly declared that such power shall include power to regulate the lighting of all vehicles other than motor vehicles. (3) Tho Lights on Vehicles Act 1915, and the Lights on Vehicles Amendment Act 1926, are hereby concqueatially repealed as from tho first day of June, 1935. 18. That we approve the proposal that the Minister of Transport may at :.uy time by notice published in the Gazette disallow wholly or in part any Iv-law made by- any local authority whether before or after the passing of this Act relating directly to motor traffic or relating to any other form of traffic in its relationship to motor traffic on the grounds that the subject matter of such by-law should not be dealt with otherwise 'than by statute or by regulation of general application made under the principal Act. 19. That we approve the machinery clauses following the foregoing. 20. That we are of the opinion that V able to the Consolidated Funds. shall not be rebated to users irrespective of its use. ?1.
