RIVER BANK LEVELS
(To the Editor.) Sir,—ln reply to Mr, Bainbridge's letter- of the 26th. inst. re stop bank levels, I have this day submitted the following questions to the solicitor for the Clive and district ratepayers’ committee. No doubt Mr Bainbridge will be able to plough with my heifer and find his answer hidden in my riddles.” . 1) The stop bank on my side of the river is on a lower level than the stop bank on the opposite side. Have I the right to enter upon the Rivers Board bank and raise the same to any height desired wthout the consent of the River Board?— Answer. No. (2) If without such consent I raise the bank, may the Rivers Board remove the spoil I have put on?— Answer. Yes (3) If the settlers petition the Board to raise the bank to the level of the opposite bank, but for reasons which appear sufficient to them, they decline to raise my bank, would 1 have any hope of success in an action for damages?—Answer, No. (4) If there be proof that the overseer knew of my raising the banks yet did not report to the chairman, what legal action-- may the Board take against himf—Answer: The board could, if satisfied that the overseer had deliberately neglected to do his duty dismiss him Yours etc., H.
