UNUSUAL CASE FROM HAMILTON. A LOAN THAT WAS NOT REPAID (Par Press Association.! Hamilton, September 4. Charles Delbeth, of Horotiu, a farmer, sued his son-in-law, Lawrence Edward Dwyer, at the Supreme Court to-day for the sum of £750, stating that Dwyer had cost him lietwee.il £2OOO and £3OOO. In addition to this sum Dwyer, having early last year operated service cars between Hamilton and Auckland, became insolvent, with a large deficit. His creditors threatened a prosecution on the grounds of negligence and extravagant living, but consented to withhold proceedings provided a certain dividend was paid. Dwyer borrowed £750 from his father-in-law, promising to repay the money within a fortnight with money from an uncle in Wanganui, who paid this sum to the Assignee and obtained a stay of criminal proceedings. The loan was never repaid and Dwyer disappeared from the district. After filing the defence in the present suit, his solicitor told the Court he was unable to find his client. Mr Justice Ostler gave judgment for the full amount.
