MAGISTRATE’S COURT

WEEKLY HASTINGS SITTING. RE-HEARING~GRANTED. The usual weekly sitting of the Magistrate’s Court was held in Hastings this morning, when Mr. A. M. Mowlem, S.M., presided. Hamburg Jones made an application for a re-hearing on a charge ol being intoxicated while in charge of a motor-cycle. In November last he was fined £lO and his license suspended until March, 1929, The applicant stated that he was living in the country and found it most inconvenient to his work not to have his cycle. He had learnt his lesson. His Worship stated that under the circumstnces he would grant the application and the terms of the order would be removed at the end of the month. CIVIL CASES. — Judgment by default was given in the following cases:—Eric Smith v. J. Hendrip £6 5/-, costs £1 17/6; Combined Buyers Ltd. v. L. J. Ewing £lO 3/4, costs £2 15/-; T.M.V. Wines Ltd. v. H. E. Galpin £2 11/- costs £1 5/6; T.M.V. Wines Ltd v. L. M. Page £2 10/-, costs £1 3/6; T.M.V. Wines v. W. Inglis £2 11/-, costs £1 4/6; T.M.V. Wines v. R. Uncles £2 13/-, costs £1 5/6; T.M.V. Wines v. E. Hill £2 8/-, costs £1 5/6; T.M.V. Wines v. P. Dodd £2 8/-, costs £1 5/6- W. Hook v. R. McGaffin £5 2/-, costs £1 10/6; T. Donovan v. J. H. Gray £1 17/-, costs 10/-; Johnson and Jones v. David and Annie Maraki £6 16/3, costs £2 13/6. Erie Volheim was ordered to pay Alexander Clark £7 2/- within eight days, in default seven days’ imprisonment.

NAPIER SITTING. (Before Messrs A, E. Renouf and C. D. Cox, J.’s P.) CHARGE AGAINST MOTORIST. A plea of guilty was entered by Mr. C. Sorrell on behalf of Charles Joseph McCarthy, farmet of Mangateretere, to being in a state of intoxication while in charge of a motor vehicle on the Napier-Awatoto road last night. Senior-Sergeant Powell stated that ns the result of a complaint received Constable Batchelor went out to the Awatoto road. It was fpund that a car, which was well off the road, was unoccupied. The constable returned to Napier, found the defendant and arrested him as being in an intoxicated condition. Mr. Sorrell stated that the defendant noticed a car approaching. Owing to the dazzling lights he went too far off the road am. got bogged. He came back to town, where he was arrested. Defendant was subject to nerve trouble, having been under treatment for the past two years. Since 4 o'clock in the afternoon he had partaken of only five medium shandies, which would not be sufficient to affect any person in an ordinary condition. “Motorists intoxicated while in ‘charge of motor cars are becoming a great danger all ovei the Dominion.’’ said Mr. Renouf, “and it has to be stopped. Under the circumstances the defendant will be fined £2 and his license cancelled ” Senior-Sergeant Powell: I learned just now that he has not got a license. Mr. Renouf: That alters the posi tiom The defendant will be fined £5 and will be disqualified from holding a license until March next. A request that the defendant's name be suppressed was refused. CHARGE OF FALSE PRETENCES. William Henry Bowman appeared on remand, charged with false pre tences at Hastings, and was further remanded to appear at Hastings on September 12. The accused made application for bail. “1 must oppose the application,” said Senior-Sergeant Powell. “This man is not unknown to the police, and there are a number of other charges pending. A warrant for his arrest was out for a long time but he kept himself out of the way so that the police could not get him.” The accused: 1 have never been out of Napier since the warrant was out. I have not buried myself in any way. I have been in the town almost every day. The Bench, however, agreed to allow bail in a personal surety of £lOO and a surety for a similar amount.
