Johnston counter-claimed lor £5l. the sale. Alter hearing evidence at length, the Magistrate held that the plaintiff <ll. Johnston), on the counterclaim, had iailed to provc misrepresentation, and gave judgment thereon for the defendant (E. W. Crook), with costs £3 3 -, and for the plaint ill (E. W.
