BREACH OF MINERS’ AWARD.

DECISION IN TEST CASE. Greymouth, Sept. 19. The magistrate, Mr. Meldrum, gave reserved decision to-day in the case in which numerous Blackball miners were proceeded against by the Labour Department for refusing to observe the provision in the award that the full eight hours be worked on pay Fridays and back Saturdays, the miners contending that the award was opposed to the recognised district custom. Mr Meldnim convicted defendant in a test case, imposing a fine of £l, with costs, declaring that an award overrides any custom inconsistent with the terms of an award. The proper place to get the custom recognised was the Conciliation Council or the Arbitration Court. He was hound by the award and could not go into the merits of the custom. Leave to appeal was granted.
