A case in winch Wilson ami Zielc sued Harrv Hills for £2 2-. cost m a dental plate manufactured by the plaintiff, was heard this morning, w Mr. Lu«k appeared for the p7unQff. and Mr. Dunn fi r the defendant. Henry Charles Wilson, a member of the firm of Wilsi.n and Zielc. said he took the impression of the plaintiff's mouth, but nothing was said concerning the cost of rhe plate unto a later date. The plate was nc* delivered. as the defendant tli«l not return. Later witness wrote a letter to him. and a week or two after he received an offer of 3i) - for the dental work. He refused the offer. Alice Bissell, an assistant at Wilson and Ziele’s. said she was present when Mr. Wilson stated the price would be £2 2 Harry Hills, defendant in the action. .an engine-driver in the employ of Mr. ArnniT. said lie was working in Wilson and Ziele’s back yard, when he asked Mr. M ilson if he would make him some teeth ami howmuch they would net. Wilson replied that as tie was working on the job he would do the work cheap. Mr. Wilson did not say hr would charge £2 2- for the teeth. He offered ::i> -. and Wilson replied that was not the price he put on them. He had never wobn the teeth more than 20 minutes since he had them, as they d:d not fit properly, and they hurt. William McLean, a quarryman. said he knew the defendant HarryHills. and in June last was working with him in the back yard of Wilson and Ziele. Witness heard Mr. Hills ask Mr. Wilson about the price of some teeth. Mr. Wdson examined the defendant's mouth, and said that he would do them for 30 -. as lie was working on the job. The conversaIkion took place during the lunch nour.

His Worship-said that tie was certain the bargain was made in the surgery, and also that the price fixed was £2 2-. Judgment would be given for the plaintiff accordingly with costs to the extent of £l 12 -. ARSEXE LE PETIT v. W. E. MORRISOX. Mr. Humphries appeared for (apt. Morrison. Arsene le Petit, plaintiff, deposed that he was suing the defendant S r £». This was for a soldier’s uniform. £6 10 - was fixed for the uniform, and the remaintier of the money was tor a cap, and some alterations to a set of pockets. The money had never been paid. The defendant, Capt. Morrison, cf the permanent Territorial Staff, stationed at Xapier. deposed that he visited Mr. Le Petit, ami they agreed after a time to have the complete uniform made for L’b. or not more than £6 -- Witness mentioned that this was more than he was m the habit of pacing, but agreed to it. The uniform was then made, but when witness had the uniform fitted he found the pockets were wrong. Capt. Skelly’s uniform was used for a pattern. Several mistakes were made in the shape of the suit. After these had been rectified, the uniform was forwarded with an account for £7 12 . The uniform was not then complete, and more alterations had to be made. These were done, amt an account for £8 was sent in. There was no difference between the uniform of a captain and a lieutenant, except in the addition <»f a star. He offered l.e.Petit £7 eg*!. for the suit, hut it was refused. Mr. Le Petit said he denied all the complaints. An argument between the witness and plaintiff ensued. Majot Si mm. of the Territorial Force, deposed that he had a lengthy experience as a tailor. The uniform supplied to Capt. Morrison was not well made, ami was very unsatisfactory. The uniform corresponded approximately to the regulations. Witness paid. £3 15 ■ for hi* uniform, the cap costing an e.xtr.y * C. His Worship reviewed the evidence. ami gave judgment for the plaintiff for £4 I" - and costs.
