NAPIER BOROUGH COUNCIL. MUNICIPAL THEATRE. TENDERS are invited by the Napier Borough Council for the erection in Napier of a Municipal Theatre. Each tender must be made on the form supplied by the Council, and must be accompanied by a deposit of £250 in cash ©r by cheque, marked in accordance with the conditions of tendering. Tenders must be enclosed in sealed envelope addressed to the, Town Clerk, and marked "Municipal Theatre Tender.” Tenders close at 10 a.m. on MONDAY, 31 st inst. WHEREAS an action was commenced by us in the Auckland office of the Supreme Court of New Zealand, on or about the 31st day of May. 1911. praying for an injunction and damages against Mi-. T. H. Garland, of Auckland, manufacturer, for infringing our trade mark for "Irish Moss” and selling "Irish Moss” not manufactured by us, under a make-up similar to ours, and t he said action was settled by the defendant consenting to the injunction and paying damages and costs : THIS IS TO INTIMATE that we shall at once commence proceedings against any 7 other persons who may sell or attempt to sell under our trade mark or any 7 imitation thereof " Irish Moss ” not manufactured by us.
