NAPIER MAGISTRATE'S COURT.
Monday, July 16. (Before Mr A. Turnbull, P.M.) E. S, Kirkpatriok, charged with having been under the influence of drink whilst in charge of a cab, was fined £1 with 13a costs. J. Vigor Brown wa3 ohargeS with having on July 6th last stored on the premises of his firm in Station-street a larger quantity of kerosene than his borough lioense permitted him. Mr Lußk for the defence submitted that the defendant had erred in ignorance of the byelaw, acting under the belief that kerosene could be stored in the yard besides in the building. On discovering that tho byelaw had been infringed, Mr Brown immediately took out five additional licenses, in order to comply with the provisions. Mr Logan appeared for the Corporation, and stated it was the first case of tho kind brought before the Court. A fine of Gs was imposed with 7s costs. Twenty-one caso3 to compel parents to send their children to school were brought before the Court by Mr A'Deane, truant officer. The defendants were represented by Mr Cornford. Acoording to the prosecutor, all the children are attending the Catholic schools, though no formal exemption from attending public schools had been obtained. In one case called on the truant officer stated that the notice had been served on the wife of the defendant. Counsel contended that this was not sufficient, as the person charged should have been served with the notice The S.M. upheld the contention and dismissed the case. As all the other cases were on a similar footing, the prosecutor withdrew them, and fresh proceedings would be taken.
