SUPERIOR COURT OF BANKRUPTCY.
Tuesday, December 7. (Before his Honor the Chief Justice.) FRAUDULENT BANKRUPTCY. John Foloy, platelayer, of Makatoku, was brought before the Court. His Honor said the evidence disclosed an intention to defraud' by obtaining goods for which Foley could not expect to pay. It was also in evidence that he had twice previously been bankrupt. It was quite clear that Foley had not reasonable hope of being able to pay for the goods he ordered ; but he (His Honor) must at the same time bear in mind that there had been a very culpable giving .of credit by those to whom Foley had applied. No doubt tho easiness of obtaining credit conduced to such conduct. He would also bear in mind that Foley would probably lose his place, and that his wife and family were not in a position to maintain themselves. The sentence of the Court would be imprisonment with hard labor for one calendar month. AI'I'HAT, DISMISSED. Mr Dick made an application in tho estate of Carl Schmidt. The debtor had given a bill-of-salo over certain property, and the creditors had disputed its validity and appealed to the Registrar, who had given a decision upholding tho bill. Notice of appeal to the Court was given, but no time had been named within which the appeal should be presented, and to secure finality to tho proceedings he (Mr Dick), with the assent of the other side, moved that the notice be struck out. The application was granted.
