LEGISLATION ANOMALY
Can Prisoners be Extradited to Australian States? A PECULIAR SITUATION QUESTION FOR THE OOURT (By Twegrapn—Fresa Association/) WELLINGTON, To-day. A Full Bench of the Supreme Court to-day is considering whether or not extradition orders can. be made from New Zealand to separate States of Australia within the Fugitive Offenders Act ISsl. ' '
If those States are a group of British possessions within the meaning of the legislation William Campbell and Madge Munro of Sydney, who were arrested in Wellington, may be extradited to Australia, and if not, there is no machinery in New Zealand for extradition in respect to an Australian State. Warrants and Ordcrs-in-Council under the Act, which Is an Imperial Act, are ultra vires, in which case the prisoners have been held illegally, and must be released.
The matter is .of widest importance and an Imperial Order-in-Council would be necessary to cure such a defect, which in all probability would take several months. Legal argument is proceeding.
